Terms of Service

These Terms of Service ("Terms") are an agreement between you and Appsaic, a brand of Implicit Marketing INC ("Appsaic," "we," "us," or "our"). They govern your use of our iOS applications — including AnyChat, CalTrack (Calorie Tracker), Fastd (Fasting Tracker), and OnTrack (The Calorie Tracker) — and our website, appsaic.com (together, the "Services"). By downloading, installing, or using any of the Services, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Services.

Who May Use the Services

You must be at least 13 years old (or the minimum age required in your country) to use the Services. If you are under 18, you may use the Services only with the involvement and consent of a parent or guardian. By using the Services, you represent that you meet these requirements.

Your License to Use Our Apps

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use our apps on Apple-branded devices that you own or control, as permitted by the App Store Terms of Service. Where an app is downloaded from Apple's App Store, Apple's standard Licensed Application End User License Agreement also applies to the extent it is not in conflict with these Terms.

Subscriptions and Purchases

Some apps offer premium features through auto-renewing subscriptions or one-time purchases, billed by Apple through your Apple Account:

• Payment is charged at confirmation of purchase.
• Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period; your account is charged for renewal within 24 hours before the period ends, at the price shown when you subscribed (or as updated with notice).
• You can manage or cancel subscriptions anytime in your device Settings → your name → Subscriptions.
• If a free trial is offered, any unused portion is forfeited when you purchase a subscription; the subscription begins automatically when the trial ends unless cancelled beforehand.
• All billing, refunds, and payment disputes are handled by Apple under Apple's terms. To request a refund, visit reportaproblem.apple.com. Except where required by law, amounts paid are non-refundable by us and unused portions of a subscription period are not refunded.
• Prices may change; changes apply to future billing periods after reasonable notice, and you can cancel before they take effect.

Health & Fitness Disclaimer

• Consult a physician or qualified health professional before starting any diet, fasting protocol, or exercise program — especially if you are pregnant or nursing, under 18, taking medication, or have any medical condition, including diabetes, low blood pressure, or a history of disordered eating.
• Intermittent fasting and calorie restriction are not appropriate for everyone. Stop and seek medical attention if you feel unwell.
• Nutrition information — including AI photo estimates, barcode results, and database entries — is approximate and may be inaccurate. Verify anything you rely on, particularly if you have allergies or medical dietary requirements.
• Never disregard or delay seeking professional medical advice because of something in our apps. In an emergency, call your local emergency number.

AI Features Disclaimer

Features powered by artificial intelligence — including AnyChat conversations and photo-based food recognition — generate content automatically from third-party models. AI output can be incorrect, incomplete, outdated, or biased, and may occasionally be similar to content generated for others.

• AI output is provided for informational and creative purposes only and is not professional advice of any kind — medical, legal, financial, or otherwise.
• You are responsible for evaluating AI output before relying on it or sharing it, and for how you use it.
• You must not use AI features to generate content that is illegal, harmful, or violates the rights of others, or attempt to circumvent safety measures of the underlying models.
• Availability of specific third-party models is not guaranteed and may change without notice.

Acceptable Use

You agree not to:

• Use the Services for any illegal purpose or in violation of any law
• Reverse engineer, decompile, or disassemble our apps, except where such restriction is prohibited by law
• Copy, resell, rent, lease, or redistribute the Services or access to them
• Interfere with, disrupt, or place undue load on the Services, or attempt to gain unauthorized access to our systems or other users' data
• Use bots, scrapers, or other automated means to access the Services without our written permission
• Remove or alter any copyright, trademark, or other proprietary notices
• Upload or transmit malware or content that infringes the rights of others

Your Content

You keep all rights to the content you create or submit in our apps — chats, photos, logs, and notes. You grant us a limited, worldwide, royalty-free license to host, store, transmit, and process that content solely to operate and improve the Services (for example, sending a meal photo to an AI provider to estimate its nutrition). You are responsible for your content and must have the rights necessary to submit it.

Our Intellectual Property

The Services — including their design, code, graphics, names, and logos — are owned by us or our licensors and are protected by copyright, trademark, and other laws. Except for the license expressly granted to you, no rights are transferred to you. If you believe content available through the Services infringes your copyright, email support@appsaic.com with details and we will investigate promptly.

Third-Party Services and Advertising

The Services rely on third-party services — including Apple (distribution, payments, HealthKit), AI model providers, and advertising networks such as Google AdMob in ad-supported apps. We are not responsible for third-party services, their content, or their terms, and links to third-party sites are provided for convenience only. Ads displayed in our apps do not constitute our endorsement of the advertised products.

Changes to the Services

We are a small studio that ships often. We may add, change, or remove features, or discontinue an app entirely, at any time. Where reasonably possible we will give notice of material changes that affect paid features, and Apple's refund process remains available to you.

Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY CONTENT — INCLUDING AI OUTPUT AND NUTRITION ESTIMATES — IS ACCURATE OR RELIABLE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, APPSAIC AND IMPLICIT MARKETING INC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR HEALTH OUTCOMES, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US THROUGH THE SERVICES IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR (B) FIFTY US DOLLARS (US$50). THESE LIMITS DO NOT APPLY WHERE PROHIBITED BY LAW.

Indemnification

You agree to indemnify and hold harmless Appsaic and Implicit Marketing INC, and their officers, employees, and agents, from claims, damages, and expenses (including reasonable attorneys' fees) arising from your content, your use of the Services, or your violation of these Terms or of any law or third-party right.

Apple as Third-Party Beneficiary

For apps obtained from the App Store: these Terms are between you and us, not Apple. Apple has no obligation to provide maintenance or support and is not responsible for any product warranties or for addressing claims relating to the apps (including product liability, regulatory compliance, and IP claims), except that if an app fails to conform to an applicable warranty you may notify Apple for a refund of the purchase price. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government list of prohibited or restricted parties.

Termination

You may stop using the Services at any time by deleting our apps. We may suspend or terminate your access if you violate these Terms or where necessary to protect the Services or other users. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitations of liability, and indemnification — survive.

Changes to These Terms

We may update these Terms from time to time. We will post the updated version here with a new effective date, and for material changes we will provide additional notice in the relevant app or on this site. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

Governing Law and Disputes

These Terms are governed by the laws of the United States and of the state in which Implicit Marketing INC is organized, without regard to conflict-of-law principles. Before filing any claim, you agree to contact us at support@appsaic.com and give us a good-faith opportunity to resolve the dispute informally within 30 days. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in that state, and you consent to their jurisdiction. If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect, and the unenforceable provision will be enforced to the maximum extent permitted. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Services.
